A comprehensive search helps to identify any existing registered trademarks or pending applications that are identical or deceptively similar to your mark.

Skipping this step can lead to significant delays, objections, or even the outright rejection of your application. A clear search result, on the other hand, gives you the confidence to proceed with the filing, saving you time and money in the long run.


Step 2: Preparing and Filing the Application

Once your trademark search confirms that your mark is available, you can begin the application filing. The application, officially known as Form TM-A, must be submitted to the Trademark Registry. The most common and recommended method is to file online through the official e-filing portal, as it is faster and more cost-effective.


To complete this stage of the trademark registration process, you will need to prepare several key documents, including:


  • A clear representation of your trademark (in JPEG format).

  • Your name and address details.

  • Your business registration documents (e.g., Certificate of Incorporation, Partnership Deed, or Proprietorship proof).

Upon successful filing, the Trademark Registry will immediately provide you with an application allotment number. At this point, you can legally begin using the "™" symbol next to your brand name, indicating that your mark is under the trademark registration process.


Step 3: Examination by the Trademark Office

After filing, your application is assigned to a trademark examiner. The examiner reviews your application to ensure it complies with the provisions of the Trademarks Act, 1999. This examination includes checking for any objections on either absolute grounds (e.g., lack of distinctiveness) or relative grounds (e.g., similarity to existing marks).


If the examiner finds any objections, they will issue an examination report. You will have a period to file a detailed response to the objections, providing legal arguments and supporting documents to justify your application. If the examiner is satisfied with your response, the application will be marked as "Accepted."


Step 4: Publication in the Trademark Journal

Once your application is accepted, the trademark is published in the official Trademark Journal. This publication serves a crucial purpose: it gives the public a four-month window to file a formal opposition to your trademark. Any individual or business that believes your mark could cause confusion or infringe on their existing rights can file an opposition.


This stage is a final public check before the mark proceeds to registration. If an opposition is filed, you will have the opportunity to defend your application through a formal opposition proceeding.


Step 5: Grant of Registration

If no opposition is filed during the four-month period, or if an opposition is successfully resolved in your favor, your trademark is approved for registration. The Registrar of Trademarks will then issue a registration certificate. This certificate is the official document that grants you the exclusive right to use your trademark across India for a period of 10 years. With this certificate in hand, you can now use the "®" symbol next to your brand, signaling that your mark is legally protected. The entire trademark registration process typically takes between 18 to 24 months, provided there are no objections or oppositions.
